About this course
This course looks in detail at some of the more difficult advice topics around the work capability assessment (WCA). Aimed at advisers with a good background knowledge of the WCA rules, the course focuses on the ‘substantial risk’ criteria and how to apply them to clients who do not fit into point-scoring categories.
The course also looks at how to optimise WCA challenges at the revision and appeal stages by taking a technical approach, based on identifying the relevant regulations and supporting case law.
The course covers:
- Finding the work capability regulations, case law and DWP guidance
- The substantial risk rules – also known as ‘exceptional circumstances’ rules
- Case law to support substantial risk arguments
- Recurring issues with substantial risk, and how to address them
- Best practice in writing a work capability appeal or revision request
- Supporting evidence
