After 14 years, the DWP finally plans to complete the rollout of universal credit (UC) by April 2026.
Advisers are now supporting the final legacy claimants – most getting employment and support allowance (ESA) – through the migration process. Claimants who have already made the move will continue to seek advice about the amount (and future) of their transitional protection, and everyone in the sector will remain on the look-out for those who haven’t claimed UC by their deadline day.
In this online seminar, we will give an update on managed migration, including:
- the latest on extensions and cancellations
- insights into the DWP’s ‘enhanced support journey’
- correct approach to overpayments of legacy benefits for periods after UC is claimed
- recurring issues for those migrating from ESA, and how to tackle these
- an in-depth look at SSWP v MJ [2025] UKUT 035 (AAC) case which held it was unlawful discrimination under the Human Rights Act 1998 to erode transitional element by the whole of the LCWRA element for carers who had a carer’s element included in their award at transition.
This webinar is designed for experienced benefit advisers and assumes a level of background knowledge about the rules of the benefit system.
Speakers will include:
Owen Stevens: CPAG welfare rights adviser, specialising in UC advice.
Ruby Sullivan: CPAG welfare rights adviser and Early Warning System Officer.
Julia Smyth KC (Landmark Chambers): Julia was instructed by CPAG in the SSWP v MJ case. Julia has acted in many important social security cases on behalf of both Government and claimants.
Martin Williams: CPAG welfare rights adviser working on the Upper Tribunal project will facilitate the webinar.
Method of delivery and timings:
- The webinar will run from 1:30pm to 4pm on Thursday 3rd July 2025.
- It will be delivered live online, via Zoom, and there will be an opportunity for attendees to ask the speakers questions.
- Participants will receive an email link, a few days before the webinar, to allow access to the event.
