About this course
This half-day course looks at the transitional protection available to claimants on migration from legacy benefits to universal credit (UC). It focuses on the protection available for claimants getting income-related ESA, the benefit that will be the subject of most remaining migration activity during 2025. (The course does not attempt to cover transitional protection for claimants migrating to UC from tax credits.)
In particular, the course will cover the UC transitional element (in the context of managed migration to UC) and the transitional SDP element (in the context of natural migration to UC).
This will include:
- The transitional element – basics, problems and ESA issues
- The transitional SDP element – basics, problems and ESA issues
- ‘Erosion’ of elements – rules and caselaw
